Who’s Eligible?
All individuals residing in the United States whose personal information was potentially compromised in the First Choice Dental data breach identified in October 2023 may be eligible to participate in this settlement.
Proof of Loss
To receive reimbursement for documented out-of-pocket losses, claimants must submit supporting materials such as receipts, billing statements, invoices, or other records that reasonably demonstrate the expenses incurred as a result of the data breach.
No documentation is required to receive the $50 alternative cash payment or to enroll in complimentary credit monitoring and identity protection services.

First Choice Dental has agreed to pay $1.225 million to resolve a class action lawsuit related to a data security incident identified in October 2023.
According to the lawsuit, unauthorized parties may have gained access to sensitive personal information, including names, dates of birth, Social Security numbers, driver’s license numbers, financial account information, and certain health-related data. Plaintiffs alleged that inadequate data protection practices exposed consumers to an increased risk of identity theft and fraud.
First Choice Dental, which operates primarily in Wisconsin, denies all allegations of wrongdoing. The company agreed to the settlement to avoid the cost and uncertainty of continued litigation.
Settlement Benefits
Eligible class members may qualify for the following relief:
Reimbursement for Documented Losses
Class members may submit claims for up to $6,000 in verified out-of-pocket expenses reasonably connected to the data breach. Covered losses may include fraudulent transactions, identity theft recovery costs, credit monitoring expenses, or professional service fees.
Alternative Cash Payment
Individuals who did not incur financial losses may elect to receive a $50 cash payment.
Credit Monitoring and Identity Protection
All approved claimants are eligible for three years of complimentary credit monitoring and identity theft protection, which includes up to $1 million in identity theft insurance coverage.
